1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of dailyherwellness.com (the "Site") and any products, services, or content offered by Daily Her Wellness, LLC ("Daily Her," "we," "our," or "us"). By using the Site or purchasing our products, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site.

2. Eligibility

You must be at least 18 years old to purchase products from the Site. By placing an order, you represent that you are of legal age and have the legal capacity to enter into this agreement.

3. Products & Health Disclaimer

Our products are intended as part of a healthy lifestyle that includes balanced nutrition, regular physical activity, and appropriate medical care when needed. They are not a substitute for any of these.

Product descriptions, ingredient information, and images are provided for informational purposes. We make reasonable efforts to ensure accuracy but do not warrant that all content is error-free.

4. Orders, Pricing & Payment

All prices are listed in U.S. dollars unless otherwise noted. Prices are subject to change without notice. Applicable sales taxes will be added at checkout based on the shipping destination.

By placing an order, you authorize us to charge your payment method for the total order amount, including taxes and shipping. We accept major credit cards and selected digital payment options through our PCI-compliant payment processor.

We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or product unavailability. If we cancel your order, we will refund any charges promptly.

5. Shipping & Delivery

Shipping rates, methods, and delivery times are described on our Shipping page. Estimated delivery times are not guaranteed. Risk of loss passes to you upon delivery to the carrier.

6. Returns & Refunds

We offer a 60-day return window from the date of delivery. Full details are available on our Shipping & Returns page. To start a return, contact hello@dailyherwellness.com.

7. Subscription Services

If you enroll in a subscription, you authorize us to charge your payment method on the recurring schedule you select, until you cancel. You may pause, skip, or cancel your subscription at any time through your account dashboard, with no fees or minimum commitments. Cancellations must be made at least 24 hours before the next scheduled shipment to apply to that shipment.

8. Account Responsibility

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

9. Intellectual Property

All Site content — including text, images, logos, design, and software — is the property of Daily Her Wellness, LLC or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.

10. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any systems, accounts, or data
• Use automated tools to scrape or harvest content from the Site
• Interfere with the operation of the Site
• Submit false or misleading information
• Resell our products without written authorization

11. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE DO NOT WARRANT ANY SPECIFIC HEALTH OUTCOMES FROM USE OF OUR PRODUCTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DAILY HER WELLNESS, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Daily Her Wellness, LLC and its affiliates from any claims, damages, or expenses arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that you may bring claims in small claims court if eligible.

Class Action Waiver: You agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing legal@dailyherwellness.com.

15. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles. Subject to the arbitration provision above, any judicial action shall be brought exclusively in the state or federal courts located in Travis County, Texas.

16. Changes to Terms

We may revise these Terms at any time by posting an updated version on the Site. Material changes will be announced through the Site or by email. Continued use of the Site after changes constitutes your acceptance of the revised Terms.
